Why did you free Galamsey Queen? – Coalition demands answers

The Media Coalition Against Illegal Mining is demanding that Attorney General Gloria Akuffo explain to Ghanaians why she filed a nolle prosequoi in the ‘Aisha’ Huang case.

No sooner had the state discontinued the case than En Huang, a.k.a. Aisha and her four other Chinese accomplices, deported on Wednesday, 19 December 2018.

The 31-year-old woman had been standing trial for mining offences at Bepotenten in the Ashanti Region.

Aisha Huang was charged with three counts of undertaking small-scale mining operations contrary to Section 99 (1) of the Minerals and Mining Act, 2006 (Act 703); providing mining support services without valid registration with the Minerals Commission contrary to the Minerals and Mining Act, 2006 (Act 703); and illegally employing foreign nationals contrary to the Immigration Act, 2000 (Act 573).

In a statement, however, the Media Coalition Against Illegal Mining said Ghanaians have the right to know why the case was discontinued.

“We do not subscribe to the view that by our laws, the Attorney General’s power to issue a nolle prosequi is based on an absolute unquestioned discretion so that she is not expected to provide an explanation for such a filing.”

The group averred that Article 269 of the 1992 Constitution fritters the discretionary use of such power.

“Thus, the AttorneyGeneral may be called upon, particularly when the matter is one of extreme public interest, such as this case, to offer a clear explanation as to why she became disinterested, and particularly on a day that the investigator in the case was supposed to continue his evidence”, the group insisted.
